Food: Commission adopts landmark list of permitted health claims
食品に 薬効 もどきを 期待する人がいるから・・・

　　Brussels, 16 May 2012

- Health claims on food labelling and in advertising, for example on the role of calcium and bone health or vitamin C and the immune system, have become vital marketing tools to attract consumers' attention. Therefore EU consumers expect accurate information on products they buy, in particular on the health claims the products may put forward.

　Today, a list of 222 health claims has been approved by the Commission. This list is based on sound scientific advice, will be used throughout the EU and will also help to remove misleading claims from the market before the end of the year.

　Claims for which the authorisation process is complete will be listed in the Union Register of nutrition and health claims made on foods, as required by Regulation (EC) No 1924/2006 on nutrition and health claims made on foods.

　This Union Register is an interactive database and is on the Commission's website.

Questions and Answers on the list of permitted Health Claims on food products
Ｑ＆Ａ です。

　　・Why has the EU tackled the issue of "health claims" on food products?

　Consumers are looking for added value when purchasing food. They attach great importance to health and are becoming increasingly aware of its relationship with their diet and the food they eat. Health claims can therefore be an important source of information, and became a vital marketing tool used by food business operators to attract consumer attention and influence choice. Concern that health claims could be less than informative or be misleading, by accident or by design, has given voice to calls for clear rules on authorisation and tighter controls.

　The so-called claims Regulation from 2006 ensures a high level of protection for consumers while in parallel ensures legal clarity and fair competition for food business operators. Claims must not mislead consumers; they must be, accurate, truthful, understandable and substantiated by science. Implementation of this Regulation requires the adoption of a list of permitted health claims, based on an assessment by the European Food Safety Authority (EFSA) of the science substantiating the claimed effect, and compliance with the other general and specific requirements of the Regulation. This list of permitted health claims is today adopted by the Commission after scrutiny by the European Parliament and the Council and will be published in the Official Journal.

　　Today,

　the European Data Protection Supervisor (EDPS) adopted his opinion on the Commission's Open Data Package, which includes a series of measures to facilitate a wider and innovative re-use of public sector information (PSI).

　The opinion highlights the need for specific safeguards for data protection whenever PSI contains personal data.

　It recommends that public sector bodies take a 'proactive approach' when making personal data available for re-use. This would make it possible to make data publicly available, on a case by case basis, subject to conditions and safeguards in compliance with data protection rules.

　　Peter Hustinx, EDPS, says:

　"The re-use of PSI containing personal data may bring significant benefits, but also entails great risks to the protection of personal data, due to the wide variety of data held by public sector bodies.

米国入国時採集の個人情報が15年だか保存されるとか、IC乗車券の履歴閲覧とか、何処の国でも 得られた情報を 最大限に活用(!) したがる 輩 には事欠かないようで。 RFID によるショッピング状況把握、赤裸々な個人情報を平気でアップさせるサイト や インターネットアクセス時気付かないうちに 多量に仕込まれる 情報収集目的の Cookie等、「便利さの裏に潜む個人情報収集される危険性 に 無関心な消費者」 にも責任がありますが、 肝心のシステム運営側でも 情報漏洩防止に熱心に取り組んでいながら 「システム担当者が どのデータに、何時、どの様な理由(!)でアクセス」したか無関心の(記録も残さない)管理者がいた、という話もありますし。
　「トーゴーサン（所得把握率 給与所得者:10 ・ 自営5 ・ 農業等3）」等と言われる不公平感を無くす為にも、個人情報保護 さえ しっかりしていれば 納税者番号制 には 賛成なのですが。^*

　但し、他国に対しては 非難 の意味で使用される 独裁 という 民主主義の根幹に触れる言葉を肯定的に用いる人物を 若者が 理想の上司 に選ぶような ある意味「平和ボケ、能天気 かつ 無責任(自分が支配者側にいれば安寧?)」な社会では 独裁者 に 危険な武器 を与える恐れもありますが。
　若者は 爺婆世代が 非国民 と非難、迫害されることを恐れて 身を縮めていた(多くの国民は 我が身かわいさ や 教育の成果^*により 迫害する側に移りましたが。＊: 何時の時代でも教育権を握ることが何年か後に世の中を意のままに操る布石かも。) 時代が ついこの間まであったことを 知ろうともせず、自分や子供達 が 独裁者に支配される恐ろしさ を想像することも出来ないのでしょうね。
　社会(既存政治家)に対する不満、閉塞感から ナチスを受け入れてしまった事 に対する反省 を 第二次世界大戦の最大の教訓 としていると言われる ドイツ とは まったく異なるようですが。
　但し、日本でも 戦後の 昭和天皇、今上天皇、皇太子ご一家には 平和と民主主義を尊び 常に 国民とともに という お気持ち が 脈々と伝えられていると感じられることが ある意味 救い であり 希望 でもありますが。

＊ : 先日、確定申告是正申請 で 税務署を生まれて初めて訪れた時、税務署員の丁寧な応対に好感を抱くとともに 事務処理等のご苦労 を少しでも軽減できないかと感じましたもので。
　ちなみに 個人的には 毎年 国税庁HP 申告納税手続き 所得税確定申告書作成コーナー で 家族分も含め オンライン書類作成、印字して郵送(プリンタはあっても ＩＣカードリーダが無く、出不精なもので！)しています。
　会社が全てやってくれる さらーりーまん諸氏 も 一度覗いてみては・・・・。 作業途中での随時保存・中断・再開可能、操作はわかりやすく簡単ですし、最終結果(提出書類)は PDF で保存できるため、後日、是正申請時等も便利ですから。赤いちゃんちゃんこを着る前 に利用する事態 になってもあわてないですむように。 但し、ファイル交換ソフト 等は 決してインストールしないよう 家族に言い聞かせて！

- The "Internet of Things" (IoT) is a future in which everyday objects such as phones, cars, household appliances, clothes and even food are wirelessly connected to the Internet through smart chips, and can collect and share data.

　The European Commission wants to know what framework is needed to unleash the potential economic and societal benefits of the IoT, whilst ensuring an adequate level of control of the devices gathering, processing and storing information.

　The information concerned includes users' behavioural patterns, location and preferences.

　The Commission wants to ensure that the rights of individuals are respected and is launching a public consultation inviting comments by 12th July 2012.

(2) Article 114(4) and (6) TFEU provides:

If, after the adoption by the Council or by the Commission of a harmonisation measure, a Member State deems it necessary to maintain national provisions on grounds of major needs referred to in Article 36, or relating to the protection of the environment or the working environment, it shall notify the Commission of these provisions as well as the grounds for maintaining them.

The German measures related to antimony, arsenic and mercury notified pursuant to Article 114(4) of the TFEU are not approved.

The German measures related to lead and notified pursuant to Article 114(4) of the TFEU are approved until the date of entry into force of EU provisions setting new limits for lead in toys or 21 July 2013, whichever comes first.

The German measures related to barium and notified pursuant to Article 114(4) of the TFEU are approved until the date of entry into force of EU provisions setting new limits for barium in toys or 21 July 2013, whichever comes first.

The German measures related to nitrosamines and nitrosatable substances notified pursuant to Article 114(4) of the TFEU are approved.

　　[Article 1] Subject matter and scope

　In accordance with Article 5 of, and Annexes I and III to, Directive 2010/31/EU, this Regulation establishes a comparative methodology framework to be used by Member States for calculating cost-optimal levels of minimum energy performance requirements for new and existing buildings and building elements.

　The methodology framework specifies rules for comparing energy efficiency measures, measures incorporating renewable energy sources and packages and variants of such measures, based on the primary energy performance and the cost attributed to their implementation. It also lays down how to apply these rules to selected reference buildings with the aim of identifying cost-optimal levels of minimum energy performance requirements.

　　[Article 2] Definitions

(10) Cost of greenhouse gas emissions means the monetary value of environmental damage caused by CO₂ emissions related to the energy consumption in buildings;

(26) Energy from renewable sources means energy from renewable non-fossil sources, namely wind, solar, aerothermal, geothermal, hydrothermal and ocean energy, hydropower, biomass, landfill gas, sewage treatment plant gas and biogases.

Commission Recommendation of 9 March 2012 on preparations for the roll-out of smart metering systems
「スマートメータ 導入前に 確実な 個人情報保護を！」 という 勧告 です。

　　Whereas:

(6) Smart metering systems allow processing of data, including predominantly personal data. Moreover, the deployment of smart grids and smart metering systems should allow suppliers and network operators to evolve from a broad view of energy behaviour to detailed information on the energy behaviour of individual end-consumers.

(8) The opinions of the Working Party on the protection of individuals with regard to the processing of personal data set up in accordance Article 29 of Directive 95/46/EC【個人情報保護指令】 provide guidance for identifying and developing "best available techniques" to safeguard personal data and guarantee data security when data are processed in smart metering systems and smart grids.

(10) Data protection and information security features should be built into smart metering systems before they are rolled out and used extensively. Such features can effectively improve consumers' control over the processing of personal data.

　　I. DATA PROTECTION AND SECURITY CONSIDERATIONS

1. This section provides guidance to Member States on the design and operation of smart grids and smart metering systems ensuring the fundamental right to protection of personal data.

2. This section also provides guidance on measures to be taken for the deployment of smart metering applications in order to ensure that national legislation implementing Directive 95/46/EC is, where applicable, respected when such technologies are deployed.

4. The data protection impact assessment should describe the envisaged processing operations, an assessment of the risks to the rights and freedoms of data subjects, the measures envisaged to address the risks, safeguards, security measures and mechanisms to ensure the protection of personal data and to demonstrate compliance with Directive 95/46/EC, taking into account the rights and legitimate interests of data subjects and persons concerned.

18. When deciding the range of information allowed for processing within smart grids, Member States should take all necessary measures to impose, as much as possible, use of data rendered anonymous in such a way that the individual is no longer identifiable. In cases where personal data are to be collected, processed and stored, Member States should ensure that the data are appropriate and relevant.
　Data collection should be limited to the minimum necessary for the purposes for which data are processed and data should be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed.

20. The processing of personal data by third parties offering value-added energy services should also be lawful and based on one or more of the six grounds for legitimate processing listed in Article 7 of Directive 95/46/EC.
　Where consent is chosen as the ground for processing, the consent of the data subject should be freely given, specific, informed and explicit and be given separately for each value-added service.
　The data subject should have the right to withdraw his or her consent at any time. The withdrawal of consent should not affect the lawfulness of the processing based on consent before the withdrawal.

24. Member States should ensure that personal data security is designed in at an early stage as part of the architecture of the network, within a data protection by design process. This should encompass measures to protect personal data against accidental or unlawful destruction or accidental loss and to prevent any unlawful forms of processing, in particular any unauthorised disclosure, dissemination, access to or alteration of personal data.

　新聞報道によると スマートメータの実証実験がらみで 「7〜9月の午後1〜4時、電気料金を他の時間帯の 2〜3倍高く設定し、 必要な時に使いにくく(経済弱者に使わせないように)することで、トータル使用電力量が 10〜17%減少(自主節電)した」、また、最高気温30℃の時、2010年夏(震災前) 60%の家庭がエアコンを使用していたが 2011年夏(震災後)には 30〜40%に減少という、いわば予想どおりの結果 がでたとのこと。 時間別に異なる料金体系にする為には スマートメータが必須 と証明 することが目的の調査のような。
　真夏の昼間 2〜3倍も(仮に2〜3割でも)高く されては堪(溜！)りませんが、もちろん、節電協力(強制?!)で夜間勤務シフトになった家庭には 昼間就寝する為のエアコン用電力の 特割、特配 か 補助金 があるんでしょうね。 乳幼児、病弱、やせ我慢が限界にきた老人家庭等も 家族構成から 病状・生活パターンまで記載して申請すれば 優遇されるのかな。 それとも 部屋の断熱を良くし、料金が安くなるはずの昼までに キンキンに冷やして 夕方まで持たせるか、欧米のように 公共シェルタ へ毎日退避とか。

　どこかの国では政府・官僚が 電力会社の実質国有化 に 血眼に成っているという噂ですが、まさか、経営権を握れば 節電、 電力自由化の名の下に スマートメータ普及促進 → 不評な 企業・国民の節電協力など無くても 昼間電気料金値上げによる国民の自主(半強制！)的節電が容易に。 うまくいけば 制御機能付きスマートメータ義務づけで 非常時にはボタン一つで 不急不要な家庭用電力を強制的に制限、切断し、 国家的重要機構に 電力集中供給可能。 　最低限、経営者として 個別家庭の 契約者名(優遇希望の家族名も) や 30分毎(?)の電力使用量データから類推できる 家人の行動パターン まで把握可能になるぞ、 ウッシッシ・・・ なんてことは 考えすぎでしょうね。
　個人情報保護に不慣れな 政府管理の大規模電力会社なら 鶴の一声によるソフト修正で 容易にシステム構築可能(それも公表せずとも)になる 技術進歩 が恐ろしいような・・・

What has the EU done after the Fukushima accident ?

　　Nuclear safety: stress tests

　Following last year's triple disaster in Japan, the EU decided to take a critical look at its nuclear power production and re-assess the safety and security of all nuclear power plants in the EU. All 14 Member States that operate nuclear power plants (Belgium, Bulgaria, Czech Republic, Finland, France, Germany, Hungary, the Netherlands, Romania, Slovak Republic, Slovenia, Spain, Sweden, United Kingdom) and Lithuania, which is decommissioning its nuclear power producing units, agreed to participate in these voluntary stress tests.

　The stress tests go beyond safety evaluations performed during normal licensing process and periodic reviews. They assess whether nuclear power plants can also cope with extreme unexpected events. The Fukushima accident showed us that two natural disasters can happen at the same time: the nuclear power plant could withstand the earthquake but could not cope with an up to 20 meter high tsunami wave which followed and cut off the power supply to the plant.

1) Natural disasters: earthquakes, flooding, extreme cold, extreme heat, snow, ice, storms, tornados, heavy rain and other extreme natural conditions.

2) Man-made failures and malevolent actions. These events may include airplane crashes, fires and explosions close to nuclear power plants, whether accidental or resulting from terrorist attacks.

　　参考 [Council Directive 1999/105/EC Article 2] (l) Forest Reproductive Material is divided into the following categories:

(i) "Source-identified" : Reproductive material derived from basic material which may be either a seed source or stand located within a single region of provenance and which meets the requirements set out in Annex II;

(ii) "Selected" : Reproductive material derived from basic material which shall be a stand located within a single region of provenance, which has been phenotypically selected at the population level and which meets the requirements set out in Annex III;

(iii) "Qualified" : Reproductive material derived from basic material which shall be seed orchards, parents of families, clones or clonal mixtures, the components of which have been phenotypically selected at the individual level, and which meets the requirements set out in Annex IV. 　　Brussels, 08 February 2012

- New EU rules for "organic wine" have been agreed in the Standing Committee on Organic Farming (SCOF), and will be published in the Official Journal in the coming weeks.

　With the new regulation, which will apply from the 2012 harvest, organic wine growers will be allowed to use the term "organic wine" on their labels.

　The labels must also show the EU-organic-logo and the code number of their certifier, and must respect other wine labelling rules.

　Although there are already rules for "wine made from organic grapes", these do not cover wine-making practices, i.e. the whole process from grape to wine. Wine is the one remaining sector not fully covered by the EU rules on organic farming standards under Regulation 834/2007.

Statement by Commissioner Potocnik on the new directive on waste electrical and electronic equipment (WEEE)

　　ＷＥＥＥ に関する 広報 です。

　Environment Commissioner Janez Potocnik welcomed the overwhelming support given by the European Parliament to an updated Directive on waste electrical and electronic equipment (WEEE).

　Currently only one third of electrical and electronic waste in the European Union is reported by EU Member States to be separately collected and appropriately treated. The existing binding EU collection target is 4 kg of WEEE per capita, representing about 2 million tons per year, out of around 10 million tonnes of WEEE generated per year in the EU. ・・・

　The new WEEE Directive will also give EU Member States the tools to fight illegal export of waste more effectively. Illegal shipments of WEEE disguised as legal shipments of used equipment, in order to circumvent EU waste treatment rules, are a serious problem in the EU.

　The new Directive will force exporters to test and provide documents on the nature of their shipments when the shipments run the risk of being waste.

1. For the purposes of this Section, "date of production" means:

(a) the date of slaughter in the case of carcasses, half carcasses or quarter carcases;

(b) the date of killing in the case of bodies of wild game;

(c) the date of harvesting or catching, in the case of fishery products;

(d) the date of processing, cutting, mincing or preparation, as appropriate, for any other food of animal origin.

EP supports ban of phosphates in consumer detergents

　　家庭用洗剤 リン酸塩規制 に関する 広報 です。

　Brussels, 14 December 2011:

　The European Commission welcomes the adoption by the European Parliament of the proposal to ban the use of phosphates and to limit the content of other phosphorous containing compounds in consumer laundry detergents as of 30 June 2013. Similar restrictions will apply to automatic dishwasher detergents for consumers as of 1 January 2017. When excessively discharged into water, phosphates cause algae to grow at the expense of other aquatic life.

　Member States have the possibility to advance the date of applicability when certain conditions are fulfilled and the Commission has been tasked to review the situation before 31 December 2014. The Regulation aims to reduce the amount of phosphates found in waste water and to improve water quality.

　The Regulation does not affect detergents used by professionals as technically and economically feasible alternatives are not yet available throughout the EU.

Questions and Answers on the list of permitted Health Claims

　　自動車発生ノイズ規制強化 に関する 広報 です。

　Brussels, 9 December 2011.

　The European Commission proposed today to reduce noise produced by cars, vans, buses, coaches, light and heavy trucks.

　Noise limit values would be lowered in two steps of each 2 dB(A) for passenger cars, vans, buses and coaches.

　For trucks the reduction would be 1 dB(A) in the first step and 2 dB(A) in the second step.

　The first step is to apply two years after the publication of the text once approved by the EP and Member States and the second step is foreseen three years thereafter.

　Altogether, these measures will reduce vehicle noise nuisance by some 25%.

　In addition, the Commission intends to introduce a new and more reliable test method to measure sound emissions.

　Moreover it is proposed that electric and hybrid electric vehicles can be fitted optionally with sound generating devices which would make these cars safer.

　Noise emissions limits have not changed since 1996 despite increasing traffic.
