Smoking ban in Canada

Smoking in Canada is banned in indoor public spaces and workplaces (including restaurants, bars,
and casinos), by all territories and provinces, and by the federal government. As of 2010, legislation
banning smoking within each of these jurisdictions is mostly consistent, despite the separate
development of legislation by each jurisdiction. Notable variations between the jurisdictions
include: (1) ventilated smoking rooms are permitted, (2) what distance away from a building is smoking
banned outside of a building; and (3) smoking is banned in private vehicles occupied by children.

The federal government's smoking ban in workplaces and on common carriers applies only to
federally regulated businesses, such as airports. Smoking rooms are not permitted.

Tobacco Reduction Act: Alberta

• It prohibits smoking in all public places and workplaces (January 2008)
• It bans retail displays, advertising and promotion of tobacco products (July 2008)
• It prohibits the sale of tobacco products from all health care facilities, public post-secondary
• campuses, pharmacies and stores that contain a pharmacy (January 1, 2009)

Fines A person in contravention of the Tobacco Reduction Act may be subject to fines or tickets.

• Under the Act, fines range from $1,000 to up to $100,000.
• Ticket amounts range from $250 to $500.

In British Columbia, an area within 6 m of door, window, inspiration or expiration hole of air-conditioning systems, smoking is prohibited.

VIA Canada offers a smoke-free environment. No smoking is allowed at any place in the train.
The policy allows to smoke outside of Kamloops and Jasper and other designated stations.


Many train staffs were smoking outside during the rest-stop. However, almost no passengers put light on cigarette at that time.

Whistlers Inn in front of the Jasper station is smoke-free. No smoking is allowed at any place inside the hotel.

Calgary By-law prohibits smoking in the area within 5m of an entrance or exit to a public premise, including a restaurant.

Smoking ban in Canada leads to drop in hospitalizations.

Hospital admissions for patients with heart and respiratory problems have dropped by around a third
in Canada since anti-smoking laws were introduced in 2001, a new study showed. The 10-year study
was carried out in the city of Toronto and aimed to measure the effects of banning smoking in
restaurants and bars. Research delineating the impact of smoke-free legislation on cardiovascular
and respiratory outcomes could have an immense impact on public health, given that an estimated
one billion people are expected to die during the 21st century, as a result of tobacco-related disease,"
wrote lead author Alisa Naiman from the University of Toronto. Since smoking was banned nine years
ago, hospital admissions for cardiovascular and respiratory conditions dropped to the rate of 39 percent
and 33 percent respectively, according to the article published in Canadian Medical Association Journal.
It recalled that tobacco is the leading cause of preventable death in the world, and that second-hand
smoke is the third-leading cause of poor health and premature death in the developed world.
The authors added their findings were "consistent with the evidence that exposure to second-hand
smoke is detrimental to health and legitimizes legislative efforts to reduce further exposure."

Tobacco Sale in British Columbia and Alberta

カナダではブリティシュ・コロンビア州、アルバータ州、そしてオンタリオ州でタバコの箱が一般から
見えないようにシャッター、引き出しなどにタバコを収容し商品販売時のみにふたを開けるように
定められているが、国境や国際空港の免税店は例外のようである。このことは2010年のカナダ・
米国国境にある免税店での見聞、今回のカルガリー国際空港免税店で棚にそのまま置かれた
タバコのケースをみて想定できる。理由は明らかではないが、タバコ規制は国内法であるとの
観点からそうした差別があるのかも知れない。

A tax-free price of Malboro in a cabinet of Air Canada is 39 Canada dollars for a king-size package, 200 per carton.


Keeping Your Tobacco Products Hidden From View: British Columbia

  If minors have access to the store, tobacco products and promotional items must be
• hidden from view between sales transactions, and cannot be seen from inside and
• outside the store.
  To do this, it is up to retailers to determine which method would work best for their
• store. In other jurisdictions, retailers have used the following approaches:
  Use a curtain that remains closed between sales.
  Stock tobacco products behind doors, that are closed after every sale.
  Stock tobacco products in drawers, that are closed after every sale.

カナダは州ごとに喫煙規制が異なるが、共通している事項は、レストラン、バー、カジノを含めた公共的
屋内空間および職域は全面禁煙とすることである。州によって議決できることは、建物の出入口、窓、
ダクトの取入口から、どのくらいの範囲を喫煙禁止とするか、子供が同乗した私的な車の中での喫煙禁止、
そして換気装置のある喫煙室設置の許可にかかわることである。喫煙室はホテルの喫煙客室を意味する
ものと思われる。

ブリティシュ・コロンビア州では建物出入口等からの禁煙範囲を3メートルと定めているが、バンクーバー市
では、ハワイ州などと同じく、6メートルとなっている。隣接するアルバータ州では禁止範囲は5メートルである。
欧米では歩道等にテラス席（ patio ）を設けているところが多いが、ほとんどが出入口や窓から6メートル
以内にあるので屋外席でタバコを吸うことは出来なくなる。米国メイン州では、これを15メートルとしている
のでテラス席での喫煙を法律で完全に排除できる。

今回の喫煙規制調査で感服したことは、ほとんどのホテルで喫煙客室を全廃し、屋内では一切喫煙する
ことが出来ない状況を作り出していることである。ホテルのフロントで喫煙室の有無を聞くと、当然筆者が
喫煙者と思うのであろう、必ずと言っていいほど「哀れみの目」で見つめられる。自己管理が出来ず、
有害物質をとりいれる生活に対し、軽蔑を含んだ視線を強く感じる。しかし、「自分はノン・スモカーで調査
のためにお聞きしている」と話すと急に満面の笑顔に変わる。１ヶ月前に欧州でも同じ調査をおこなったが、
特にカナダ国内では喫煙者は歓迎されないことが明確となっている。喫煙客室の比率の高いバンクーバー
のホテルでは日本人、中国人団体客を多く受け入れているためと推察できるが、年配のコンシェルジュは
「ソーリー」の言葉を使い、他のホテルのように喫煙客室を完全に排除できていないことを恥じている
ようであった。喫煙者が当たり前のように屋内空間で喫煙する姿は、日本以外では次第に見ることが
出来なくなっている、そうした社会が多くの先進国で実現しつつある。
